1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of BicepHeartTrend.art (bicephearttrend.art, the "Service"), operated by BicepHeartTrend ("we", "us", or "our"). By creating an account, uploading a photo, or using any part of the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

BicepHeartTrend.art is a specialized AI video studio that transforms a single static waist-up photo (of an adult person or a pet) into a 7-second, 9:16 vertical MP4 video performing the viral "bicep heart" choreography (smile, arm flex, and C-hand heart pose), complete with an optional hook caption and trend audio excerpt.

Uploaded images and generated clips pass through automated safety filters. Any submission flagged by our safety checks is declined automatically, and any consumed video credit is restored to your balance. We may update, modify, or discontinue studio features at any time with reasonable notice where practical.

3. Eligibility & Account Security (18+ Only)

• Age Requirement: You must be at least 18 years of age to register an account, purchase credits, or upload media to the Service.
• Account Responsibility: You agree to provide accurate sign-up details and keep your login credentials confidential. You are responsible for all activity occurring under your account. If you suspect unauthorized access, notify us immediately at support@bicephearttrend.art.

4. Photo Upload Rules & Consent Warranties

You may only upload photos that you own or have explicit permission to use. If your photo depicts a human subject, every person visible in the photo must be 18 years or older and must have given informed consent to have their likeness animated by an AI video service.

By uploading any image to bicephearttrend.art, you represent and warrant that your submission does not:

1. Depict Anyone Under 18: Uploading photos of minors or anyone who appears to be under 18 is strictly prohibited—even with parental or guardian consent;
2. Depict Celebrities or Public Figures: Do not upload photos of politicians, celebrities, athletes, or public creators without their direct personal authorization;
3. Contain Nudity, Sexual, or Explicit Content: No sexually explicit, non-consensual intimate, or suggestive imagery;
4. Harass, Bully, Defame, or Humiliate: Do not generate videos intended to mock, blackmail, stalk, or disparage another person;
5. Deceive or Impersonate: Do not pass off AI-generated clips as authentic recordings of real-world events or use them for identity fraud;
6. Infringe Third-Party Rights: Do not upload copyrighted photography or unlawful material.

Violating these upload rules may result in immediate content removal and permanent account suspension without refund.

5. Nature of AI-Generated Output

AI video synthesis is probabilistic. While our 4-beat pipeline is tuned specifically for the bicep heart pose, generated videos may occasionally exhibit visual artifacts—including imperfect finger geometry, arm proportions, clothing shifts, or facial variations depending on the lighting and angle of your source photo. Following our on-page photo checklist improves consistency, but we do not warrant that every render will be free of AI artifacts.

6. Ownership of Your Videos & License to Process

• Your Rights: You retain full ownership of the original photos you upload. Subject to your compliance with these Terms, you own the visual video animation generated from your photo (excluding third-party music rights described in Section 7) and may download and post it across TikTok, Instagram Reels, YouTube Shorts, and other platforms.
• Limited Operational License: Unlike generic platforms that claim broad distribution rights over user submissions, you grant BicepHeartTrend.art only a limited, non-exclusive, private license to host, process, and render your photo and store the resulting video solely to deliver the Service to you in accordance with our Privacy Policy. We never publicly showcase your uploads or use them to train AI models.

7. Trend Audio & Music Usage Restrictions

Videos exported with sound enabled include a short audio excerpt matching the viral trend timing. Neither BicepHeartTrend.art nor you own the underlying musical composition or master recording—those rights belong to their respective artists, songwriters, and record labels.

• Personal, Non-Commercial Social Posts Only: The built-in sound is provided solely for personal, non-commercial sharing on social platforms (such as TikTok, Reels, and Shorts).
• Commercial & Sponsored Posts: Do not use a video containing the built-in trend audio in paid advertisements, brand sponsorships, commercial promotions, or monetized commercial campaigns unless you hold a separate music license. For commercial use, toggle off the studio audio or replace the track using the social platform's licensed commercial sound library.
• Platform Moderation: Social networks may mute or restrict audio tracks based on regional licensing rules; you are responsible for complying with each platform's terms when publishing.

8. Pricing, Credits, Failed Renders & Refunds

• Credits & Plans: Paid video generations are purchased as one-time packs or plans as displayed on our pricing page. Payments are processed securely through our payment providers.
• Automatic Recovery on Failed Renders: If a render fails due to a technical timeout, server error, or automated safety refusal, no credit is deducted (or the credit is automatically returned to your balance).
• 7-Day Refund Eligibility:
  • Unused Purchases: Fully unused packs or unused credits from a pack may be refunded within 7 calendar days of purchase (pro-rated for remaining unused credits).
  • Broken Renders: If a completed render is severely corrupted (for example, failing to animate the subject in your photo), email support@bicephearttrend.art with your account email and order details within 7 days so we can re-credit or refund the affected generation.
  • Billing Errors: Duplicate or erroneous charges reported within 30 days are refunded in full.
• Disputes & Chargebacks: Please contact support@bicephearttrend.art before initiating a bank chargeback—most billing issues are resolved within 1–2 business days. Filing fraudulent chargebacks for already-downloaded videos may result in account termination.

9. Independent Tool & Non-Affiliation Disclaimer

BicepHeartTrend.art is an independent third-party AI studio. We are not affiliated with, endorsed by, sponsored by, or officially connected to TikTok, ByteDance Ltd., Instagram, YouTube, the creators who originated or popularized the bicep heart trend, or any music rights holders. All third-party product names and trademarks remain the property of their respective owners.

10. Acceptable Technical Use

You agree not to probe, scrape, reverse-engineer, overload, or bypass authentication or rate-limiting mechanisms on bicephearttrend.art, nor resell automated access to our rendering endpoints without written authorization.

11. Disclaimer of Warranties & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, BicepHeartTrend.art and its operators shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of the Service shall not exceed the total amount you paid to us during the twelve (12) months preceding the event giving rise to the claim.

12. Changes to These Terms

We may revise these Terms periodically. When we make updates, we will post the revised Terms on this page and update the "Last updated" date above. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
